ARTICLE 1: Purpose

These “terms of use” are intended to provide the legal framework for the conditions of provision of Madintouch services (the “Site”) and their use by the “User”.

The terms of use must be accepted by any User wishing to access the Site. They constitute the contract between the site and the User. Access to the site by the User signifies their acceptance of these terms of use.

Madintouch reserves the right to unilaterally modify the content of these terms of use at any time.

Non-member Users do not have access to services reserved for members. To access these, they must identify themselves using their username and password.

The Site implements all means at its disposal to ensure quality access to its services. As the obligation is one of means, the Site does not commit to achieving this result.

Any event due to force majeure resulting in a malfunction of the network or server does not engage the responsibility of Madintouch.

Access to the Site’s services may at any time be subject to interruption, suspension, or modification without notice for maintenance or any other reason. The User agrees not to claim any compensation following the interruption, suspension, or modification of this contract.

ARTICLE 5: Intellectual Property

The brands, logos, signs, and any other content of the Site are protected by the Intellectual Property Code and more particularly by copyright law.

The User must request prior authorization from the site for any reproduction, publication, or copy of the various contents.

The User commits to using the Site’s contents strictly for private purposes. Any use of the contents for commercial purposes is strictly prohibited.

ARTICLE 6: Personal Data

The information requested during registration on the Site is necessary and mandatory for the creation of the User’s account. In particular, the email address may be used by the Site for the administration, management, and animation of the service.

In accordance with the General Data Protection Regulation:

The information given on the Site is for informational purposes only. Thus, the User assumes sole responsibility for the use of the information and content of this site.

The User ensures to keep their password secret. Any disclosure of the password, in any form, is prohibited.

The User assumes the risks associated with the use of their username and password. The Site declines all responsibility.

Any use of the service by the User that directly or indirectly results in damages must be compensated to the Site.

An optimal guarantee of the security and confidentiality of transmitted data is not assured by the Site. However, the site commits to implementing all necessary means to best ensure the security and confidentiality of data.

The Site cannot be held responsible in case of force majeure or due to unforeseeable and insurmountable circumstances caused by a third party.

ARTICLE 8: Hypertext Links

Numerous outgoing hypertext links are present on the Site, however, the web pages these links lead to do not engage the responsibility of Madintouch which has no control over these links.

The User therefore agrees not to hold the Site responsible for the content and resources related to these outgoing hypertext links.

ARTICLE 9: Contract Evolution

The site reserves the right to modify the clauses stipulated in this contract at any time.

ARTICLE 10: Duration

The duration of this contract is indefinite. The contract takes effect for the User from the moment the service is used.

ARTICLE 11: Applicable Law and Jurisdiction

French legislation applies to this contract.

1. User Commitment

• By registering on Madintouch.com, you certify:

• The photo belongs to you and is true to reality, without any other recognizable person.

Certain behaviors are not allowed on Madintouch.com:

8. Immediately notifying us if a minor tries to contact you, by sending us an email (use the contact form) and reporting the message to the moderators.

When you register on Madintouch.com, you certify that you have read and accept the terms and conditions.

3. Your Registration on Madintouch.com

• Only personal dating ads are allowed.
• All registrations are verified by our moderation team before publication. Madintouch reserves the right to accept or reject ads without providing justification.
• Only one registration is allowed per person. In case of multiple registrations, you risk permanent ban from using our service.
• As soon as your ad is verified and accepted, you will be notified by email (maximum 24 hours). You will be able to contact other members immediately, and vice versa.
• You are solely responsible for the information you display and transmit on Madintouch.com.
• Your ad should reflect reality, be yourself, avoid banal or vulgar ads. You will increase your contacts by 90% if your ad stands out from others. The first step of an encounter is seduction, don’t forget it.

4. How Madintouch Works

• Once your ad is validated, you can log into your account and contact other members.
• Madintouch offers only online services and cannot guarantee results. The use of tools and resources provided by Madintouch cannot guarantee the fulfillment of members’ expectations and aspirations.
• Madintouch requests that you never disclose strictly personal information, such as your name, address, phone number, or email in your ad. If such information should appear in your ad, Madintouch reserves the right to delete it without prior notice. Abuse may result in a ban from using our services.
• You can exchange your contact details through private messaging once you are registered (phone number, email, Facebook, Skype, etc.). Private messages between members are not filtered.
• Madintouch cannot be held responsible for physical meetings between members following the use of our services. It is everyone’s responsibility to take all precautions in these circumstances. For a first meeting or date, we advise you to go to a public place such as a bar or café. Be cautious in your encounters and don’t idealize your contacts; take the time to get to know them first.

• Deactivate or delete your ad with one click.

5. Protection and use of personal data

• Madintouch is committed to respecting and protecting your privacy. The information you provide during registration is completely private and will never be disclosed to a third party under any pretext.
• At any time, you can modify your personal information either in your account or by making a request via email using the contact form on the site. However, we may modify information that is contrary to these general terms of use.
• By registering, you authorize Madintouch.com to publish the information in your ad and to use it for any promotional purposes.

6. Intellectual Property

7. Responsibility and Warranty

• Information and content provided by members:
  Each member is responsible for the accuracy of the information provided. Each member is also responsible for the information transmitted to other members through the chat. Madintouch cannot be held responsible for the accuracy of the content provided by members.
• Madintouch Operation:
  Madintouch cannot guarantee that the service will be accessible at all times. Some services may be temporarily interrupted during maintenance or updates of Madintouch. Similarly, Madintouch cannot be held responsible for non-functioning, inability to access, or poor conditions of use due to reasons external to Madintouch.
• Message Storage (messaging and chat):
  All inactive messages and attachments (photos…) are automatically deleted after one year. It will therefore not be possible to retrieve any data after this period.

8. Advertising Spaces and Promotional Offers

• We cannot be held responsible for the services or benefits offered by advertiser sites on Madintouch.com, nor for the use made of the information you may provide to them. Madintouch does not intervene in any way in transactions between the advertiser and consumers of its products and/or services.
• When registering on Madintouch, you will have the option to join a partner dating site, subject to your confirmation.
  You may receive, at most once a month, a promotional offer by email.

9. Unsubscribing

• You can unsubscribe at any time directly in your member area and thereby delete all data concerning you, your messages, and your photos.
• You can also temporarily suspend your registration without losing your account. To do this, simply deactivate your profile.
